1. Acceptance of Terms

By accessing or using Progress Academy ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Platform.

Progress Academy is operated by Lets Make Progress (Pty) Ltd, a company registered in South Africa. These terms apply to all visitors, registered users, and paying customers.

2. Products & Access

Progress Academy sells digital products including prompt packs, templates, guides, toolkits, and other downloadable resources. All products are delivered digitally — there are no physical shipments.

Upon successful payment, you will receive access to your purchased product(s) via your account dashboard. Your licence to use the product is:

• Personal and non-transferable
• For your own business or personal use only
• Not for resale, redistribution, or sub-licensing
• Not for use in AI training datasets without written permission

3. Your Account

To purchase products, you must create an account using a valid email address or a Google account. You are responsible for:

• Keeping your login credentials secure
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access

You must be at least 18 years of age, or have parental consent, to create an account and make purchases.

4. Payments & Pricing

All prices are displayed in South African Rand (ZAR) unless otherwise stated. Payments are processed securely by PayFast. We do not store your card or banking details.

Prices are subject to change without notice. The price displayed at the time of your purchase is the price you pay. Promotional pricing is valid only for the duration of the promotion.

5. Intellectual Property

All content on Progress Academy — including product files, copy, images, code, logos, and the platform itself — is owned by Lets Make Progress (Pty) Ltd or its licensors. All rights are reserved.

Your purchase grants you a limited, personal, non-exclusive licence to use the product for your own purposes. You may not:

• Sell, resell, or distribute our products to third parties
• Claim our products as your own original work
• Remove any copyright or attribution notices
• Use our branding, logo, or trademarks without written permission

6. Prohibited Uses

You agree not to use the Platform to:

• Violate any applicable law or regulation
• Infringe the rights of any third party
• Transmit spam, malware, or malicious code
• Attempt to gain unauthorised access to any part of the Platform
• Use automated tools to scrape, copy, or bulk-download content
• Engage in fraudulent transactions or chargebacks

Violation of these terms may result in immediate suspension or termination of your account.

7. Limitation of Liability

Our products are provided "as is" without warranties of any kind, express or implied. We do not guarantee specific results from using our products — outcomes depend on individual effort and circumstances.

Our total liability to you for any claim shall not exceed the amount you paid for the product in question.

8. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service, engage in fraudulent activity, or misuse our products or Platform.

You may close your account at any time by contacting us. Termination does not entitle you to a refund unless you meet the criteria in our Refund Policy.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

These terms are intended to comply with the Consumer Protection Act (CPA), the Protection of Personal Information Act (POPIA), and the Electronic Communications and Transactions Act (ECTA).

10. Progress Academy Plus Membership

Progress Academy Plus is an annual membership billed as a single upfront payment. By subscribing you accept the following terms:

• Your membership grants access to all current and future products during the active subscription period
• Membership renews annually unless cancelled before the renewal date
• Cancellation stops future billing but does not forfeit access for the remainder of the paid year — access deactivates automatically at the end of the paid period
• Lets Make Progress reserves the right to adjust Plus benefits with 30 days notice to active subscribers
• Members only products are available exclusively to active Plus subscribers and are not sold individually
• Annual subscriptions are non-refundable once payment is processed, as disclosed at the point of purchase

11. Changes to These Terms

We may update these Terms of Service from time to time. We will update the "Last updated" date at the top of this page. Significant changes will be communicated to registered users via email. Continued use of the Platform after changes are posted constitutes your acceptance of the updated terms.
